Under Article 55.01 of the Texas Penal Code, you may be eligible to erase your misdemeanor or felony charges from your record by filing a petition for expungement. According to Statute 55.01, in order to qualify for expungement your attorney must prove that you meet the following criteria:
- There can be no pending or current indictment or information charging you with a subsequent felony.
- A subsequent felony charge against you cannot have been dismissed because of expired statute of limitations (time limit).
- A subsequent felony charge against you cannot have been dismissed because of a lack of probable cause
- You are not serving any sentence for community supervision or probation
- You have not been convicted of a felony in the five years preceding the date of your arrest
- Other criteria apply
